This reminds me of Lohan sueing the commerical recently for causing her harm. It seems like a joke. From experiences, I know that an agreement like the one she would have had to sign are fairly air tight for this very reason.

I can’t see this carrying much weight. As stated, she signed a general release for the right’s holder to use the photo (I assume) as they see fit. The right’s holder (not her) gave the movie permission to use the photo most likely. Maybe she doesn’t agree with the context of the usage, but then it’s just not up to her the second she signed that release. Maybe next time she won’t sign that release which allows that usage.

I would be pretty shocked if the courts even give this quasi-pornographic argument any time at all. Considering this was a comedy in wide release, any pornography was likely implied, rather than shown directly.

One other thing the courts will no doubt think about, a decision in her favor would open the floodgates for many similar lawsuits.

In my opinion, this will likely be dismissed (or settled) before it even reaches court.
